VIDEO: D'Souza On Scalia's Shocking Death & Its Implications

Dinesh D’Souza joined Judge Jeanine Pirro February 13 on Justice with Judge Jeanine to discuss the shocking death of intellectual giant Antonin Scalia:

“Scalia had a very elastic mind and was able to look at different ways in which we read a text, not just in terms of what the author intended, but also in terms of what the text actually says.”

“Scalia was the intellectual giant on the Court, and perhaps the most eloquent Supreme Court Justice going back all the way to the early part of the 20th century. History will see him as a luminous figure.”

Explaining Scalia’s unique brand of originalism, D’Souza said:

“Scalia’s originalism was different than, for example, the originalism of Judge Bork. Bork would talk about reading the Constitution in the light of the Framers. And one of the things that Scalia would point out is that the intention of the Framers is sometimes opaque or contradictory. When you’re reading a sonnet by Shakespeare, you may not know what Shakespeare intended to say, but what you do have is the sonnet itself. And by looking at the poem, you can excavate what it actually means.”

D’Souza expressed fear over the future of the Court:

“When I got the news of Scalia’s death, I felt a sense of deep sorrow, and also a chill of fear down my spine. The Supreme Court has been so precariously balanced. It’s been very frustrating for us as conservatives that the Democrats can depend, almost with euclidean certitude, on their guys.”

Now, more than ever, D’Souza argued, is the time for Congress to assert its authority:

“We have a president who has shown a willingness to skirt the law with immigration, with the Defense of Marriage Act, and with Obamacare. We need a Supreme Court that is going to stand up for constitutionalism at this point in our history.”

“I think it’s important for the Republican Congress to signal very clearly to Obama that any nominee that he puts forward on the left is essentially dead on arrival. That forces upon Obama the choice of either pushing forward and going up in flames, or trying to come up with a unifying nominee that would actually help to bring the country together.”

    There are too many questions to his death. It sounds like the Judge was ‘laid out’. Clothing straightened, hands placed on the bed covers and a pillow over his head. Enough is enough people. This govenment cannot be left to destroy one after another who buck them.

    0bama can count on some senate Progressive Republicans voting for any fringe left extremist he puts forth. Lindsey Graham, Lamar Alexander and Susan Collins for sure. 3 liberals with an R are now gone…. 0bama’s favorite Republican, Dick Lugar is gone. So is Olympia Snowe and Judd Greg. There is one new liberal with an R that may swing with 0bama, Kelly Ayotte.
    Things are shaky, even with R’s controlling the senate.

    It’s too bad that Obama cannot wait until Justice Scalia is laid to rest to
    Start talking about replacing him. Can’t Obama give Justce Scalia the praise and honor he deserves for serving this country.

    Oh by the way, his death sounds a little fishy to me!

      Fishy, oh yes-too many odd events. I worked in healthcare for many years from paper to electronic certs, death certs were completed by MD’s. RN’s and MD’s were the only ones who could pronounce death. I thought it very odd that Presidio County Judge made the statements and not an MD (nydailynews(dot)com). I believe there most likely is some intrigue.

    The current President did not attend the funeral for the Justice because he, and his spouse, were fearful of being struck by lightening. I watched, it was a most beautiful way to say good bye, those two did not belong there.

    Never be concerned about God doing His part. It is Americans who must do their part–specifically pray II Chron. 7:14 and following up by doing it.

    Scalia could not influence the other Justices on DOMA or ObammyCare and the President will appoint whomever he wants via recess appointment..
